Position: Director of Legal Services Department (Arbitration Council Foundation)__Deadline:13-September

The Arbitration Council Foundation (ACF) is a non-political and not-for-profit organization. ACF supports the operations of Cambodia’s Arbitration Council (AC), which is an independent national institution established by law to resolve labor disputes. Supported by the Ministry of Labor and Vocational Training, employers and unions, the AC/F is recognized as a model institution for justice in labor dispute resolution of Cambodia and has been praised by national and international communities.

ACF is seeking a talented and experienced Cambodian national with outstanding qualifications for the position of Director of Legal Services (DLS) based in Phnom Penh. This is a challenging and rewarding position with a high level of responsibilities.

Key Duties and Responsibilities Executive Management Team
1-    Working with the Executive Management Team regarding technical and financial management of ACF activities, both on day-to-day and long-term basis:
  • Participating in development and implementation of strategic plans for technical, legal and financial (including budgeting and fundraising) plans for AC and ACF;
  • Providing technical assistance to AC and ACF in preparation of AC regular meetings, guidelines, strategies, budgets, policies, fee based services and in other areas as required by the Executive Director/DED;
  • Participating in meetings of the Executive Management and Finance and Administration to discuss the issues arising thereof and recommend solutions;
  • Providing technical assistance to AC and ACF in managing and resolving high level and sensitive institutional matters with and for internal and external stakeholders.
  • Representing the organization in both national and internal settings as may be required and appropriate; and
  • Participating in reporting activities to the ACF Board of Directors, donors and stakeholders as may be required and appropriate;
  • Developing and strengthening professional and structural relationship between the Director of Legal Service Department and key relevant stakeholders in order to effectively implement the legal mandate of ACF.

2-    Overseeing the staffing of ACF:
  • Participating in human resource management activities, including development of human resources policy guidelines, staff size and recruitment, staff evaluation, performance management and disciplinary action.

Legal Services Department
1-    Managing, Supervising and Directing the Provision of Legal Services to Arbitrators in Labour Dispute Cases
  • Managing the overall provision of legal services by Department to Arbitrators in labour dispute cases to ensure that the Department provides adequate and effective support to Arbitrators;
  • Regularly evaluating the arbitration services program to ensure continually improved legal support services to Arbitrators;
  • Supervising the Department members in providing direct mediation and legal support services and mentoring, as appropriate, to Arbitrators in labour dispute cases;
  • Attending meetings with Arbitrators to discuss cases;
  • Supervising the Department members in preparation of legal notes on the cases;
  • Attending arbitration hearings as an observer;
  • Conducting post-hearing conferences with Arbitrators;
  • Exercising oversight of provision of assistance to Arbitrators in the drafting of Arbitral Awards;
  • Providing feedback to Arbitrators in labour dispute cases and providing guidance on areas of potential improvement; and
  • Updating the Executive Director/DED on the progress of the labour dispute cases.

2-    Training on Labour Dispute Resolution and Developing Case Preparation Skills
  • Managing the provision of training by the Department on labour dispute resolution, development of case preparation skills and other subject areas, as needed
  • Identifying training and continuing arbitration education needs among Arbitrators, Secretariat of the Arbitration Council, and Legal Services Department officers and stakeholders with regard to the
  • labour dispute resolution process, case preparation and/or technical skills, and other subject areas, as appropriate; and
  • Developing and implementing (in cooperation with other ACF staff and appropriate external consultants) training, meetings and programs which respond to these needs.

3-    Managing, Supervising and Directing Legal Services Department, Generally:
  • Assigning reasonable tasks and workload among the Department members; including designating them to represent the Department in a certain course of activity.
  • Ensuring that the Department members complete their tasks within a communicated and reasonable time frame;
  • Providing evaluations and constructive feedback to the Department members regarding their particular assignments and their work as Department members generally, including performance evaluations  following  the  end  of  their  probationary  period  and  regular-interval  performance evaluation;
  • Managing leave and compensation time for the Department members;
  • Managing and participating in the process of the Department staff recruitment, including making the Department’s recommendations to the Executive Director;
  • Continuing to upgrade the performance and quality of the Department by identifying professional development needs and developing strategies to meet those needs;
  • Setting up systems for the Department to efficiently cooperate with other teams of ACF; and
  • Ensuring that information and reporting requirements from Department are produced and submitted in a timely manner.

4-    Preparing Publications and Other Materials, As Needed, in Support of the Arbitration Council
  • Managing the overall preparation and publication of materials in support of the AC;
  • Reviewing and analysing arbitral awards and procedural decisions;
  • Leading in reviewing and analysing the legal framework for arbitration, and other related areas of law;
  • Writing memoranda or reports on these findings;
  • Identifying and developing new publications in cooperation with other ACF staff, Arbitrators and external consultants; and
  • Overseeing and providing technical assistance in preparation of AC digests, award compilations and
  • other publication materials.

5-    Organizational Participations
  • Join in the planning process of project activities;
  • Actively cooperate with all concerned persons, stakeholders, and/or institutions to mobilise resources that are necessary for implementing project activities;
  • Implement together with the ACF team, project activities following the project work plan;
  • Jointly conduct monitoring and evaluation regularly, to assure that ACF activities are on track;
  • Try his or her best to identify solutions, should any irregularity or problem occur, otherwise he or she may request advice from advisors; and
  • Maintain regular consultation with the Executive Director of ACF. On the other hand, share views and experiences, and strengthen teamwork with all colleagues at the ACF.

The required qualities of the ideal candidate include:
  • Master Degree or higher degree in law, industrial relations, or related fields;
  • At least four years’ experience in a responsible position, working in the fields of labour law, alternative dispute resolution (including mediation and arbitration), industrial relations, rule of law, and/or legal instruction;
  • At least three years’ experience in a responsible management or leadership position;
  • Excellent legal research, analysis, drafting of arbitral awards, training, and communication skills;
  • Highly motivated individual with proven ability to take initiatives and to work efficiently under pressure;
  • Ability to work creatively within a team to analyst and solve problems;
  • Fluency in English;
  • Experience in Khmer-English-Khmer legal translation is an advantage; and
  • Excellent working knowledge of MS Office, the internet, and e-mail.
