Position: Request For Proposals: Assessment of compatibility of Cambodian national legislation with the Social Security (Minimum Standards) Convention, 1952 (No. 102) in view of a possible ratification (International Labour Organisation)__Deadline:31-May

Cambodia has an ambitious plan of accelerating economic growth over the coming decades. In addition to the pursuit of growth, meeting the growing aspirations of the population requires policies aimed at ensuring social protection across lifecycle contingencies. Aware of these challenges, the Government has placed Social Protection at the core of its priorities. The launch of the National Social Protection Policy Framework (2016-2025) was a milestone and illustrated the importance placed on social protection, which for the first time combines social security (including social health insurance) and social assistance under one single strategy.

The ILO is supporting the development of the social protection system in Cambodia through analysis, evidenced based policy and financial decision making, capacity building work and knowledge transfer. As part of this work, the ILO is providing technical cooperation in carrying out a full actuarial valuation of contributory schemes operated by National Social Security Fund of MLVT as a key element to ensure that policy and financing decisions are evidence based. The ILO actuarial valuation report are normally accompanied by an assessment of the existing provision against the ILO Social Security Convention No.102. Although the actuarial valuation covers only contributory schemes, the C102 assessment will cover both contributary and non-contributary social protection programmes.

Convention No.102 constitutes an internationally recognized and monitored safeguard that serves to guarantee that social protection benefits align to internationally agreed minimum levels. The assessment of the achievements of the Cambodian social protection schemes against the principles and standards of Convention No.102 can contribute identifying areas of intervention for ensuring adequate basic levels of income security and access to basic services, as well as setting an environment conducive to political and social stability and creating an environment attractive to business and international investments.

The ILO is looking for a local consultant to support ILO expert team to conduct this C102 assessment in Cambodia.

OBJECTIVES AND EXPECTED PRODUCTS:
Input into the report on the compatibility of Cambodia ’s social security legislation with the ILO Social Security (Minimum Standards) Convention, 1952 (No. 102) including (1) a description of the social  security system and legal framework, (2) an article by article analysis of the compatibility of the provisions of the national legislation with the articles of Convention No.102, for each of its Parts and (3) conclusions and recommendations in view of a possiblefuture ratification.
A briefing note on an overview of the social security system in Cambodia along with a general inventory of the legislation concerned.

For this product the following tasks will need to be conducted:
1.    Input into the annex of the Actuarial Valuation of the National Social Security Fund
a)    Review summary of main legal provisions
Timeline: June – July 2024
b)    Provide inputs on national legislation into a Draft an appendix containing a matrix comparing the relevant branches of the national social protection system against ILO social security minimum standards Convention No. 102 in the context of the NSSF Actuarial valuation as of 31 December 2022 being carried out by the ILO. This Appendix will compare the Cambodian social protection provisions with the key quantitative and qualitative parameters set out in Convention No. 102 (level of benefits, duration, entitlement and qualifying conditions, minimum and maximum benefits etc., financing and administration issues).
Timeline: July - September 2024
c)    Input into a section, to be finalised by the ILO, with an overall review of the legal framework in light of international social protection standards and principles, including a summary based on the detailed analysis of the matrix reflecting the prospects for ratification of Convention No.102 and necessary clarifications and/or reforms, where relevant.
Timeline: September – October 2024

2.    Input into the  assessment  of  the  national  legislation  in  view  of  a  possible  ratification  of ILO Convention No. 102
d)    Draft a briefing note containing:
(A)    An overview of the social security system in Cambodia including:
i)    a detailed account of the branches of social security which are currently in place in the country, including the contingencies covered and the type of scheme (e.g.social insurance, provident fund, employers’ liability, etc.) through which the respective branches are covered.
ii)    a general inventory of the legislation under which each branch of social security are
governed.
iii)    a mapping and explanation of other types of social protection arrangements (main cash transfer programmes, pilots, schemes etc.) that are not set out in the legislation.
iv)    a brief description of the administration of social protection (overall and for each scheme)
and of the institutional structure in place for the operation of the schemes
(B)    Input into the overall conclusions developed by the ILO on the compatibility of the national law with the requirements on Convention No. 102, and recommendations as to which Part of the Convention could be accepted, in view of a possible future ratification. Recommendations concerning possible modifications of the legislation and practice to improve compliance with the Convention and allow for the ratification of additional Parts could also be formulated.

e)    Liaise with the social partners and the relevant Ministries and institutions responsible for the  administration of social security in Cambodia to validate the findings of the analysis and to obtain feedback on the application of the legislation in practice.

f)    Consolidate and translate (in case the comments are in Khmer) stakeholders’ comments on the draft report.
Timeline: October 2023 November 2024
g)    Contribute to the agenda and presentation of the findings during a workshop to discuss the Report and possible steps towards ratification.
Timeline: November - December 2024

The work will be backstopped by ILO social protection specialists based in Cambodia, Bangkok and HQ. The production of the assessment will be closely coordinated with NSSF, NSAF, and GS-NSPC. Moreover, a brief session to clarify the ILO expectations will be held with the consultant before the project work starts.

OUTPUTS
  • Output 1 – Input into the appendix of the actuarial valuation of the National Social Security Fund on compliance with C102 for the NSSF Actuarial Valuation covering the issues referred to above
  • Output 2 – Draft a briefing note on the aforementioned issues in English
  • Output 3 – Technical support to 1 workshop to discuss with tripartite constituents the Report conclusions (draft agenda, draft presentation, meeting report).

TIMEFRAME
The assignment is expected to start in mid-June and complete in mid-December 2024 with an estimated number of working days of 20-25.

REQUIREMENT
  • Have a degree in Law, Political Science, Labour Economics from an officially recognized university
  • Have at least 5 years of working experience on Cambodian national legislations and regulations.
  • Have at least 3 years of experience in social protection, especially in Cambodia’s context.
  • Familiarity with ILO social security convention 102 and the ILO branches of social security is an asset
  • Familiarity with the Cambodian social protection governance system and regulatory framework is an asset
  • Khmer and English language proficiency. A writing sample in English should be attached to the technical application.
