Labor Dispute Resolution Procedure, Effective Case Preparation
and Presentation Technique before the Arbitration Council

I. Objectives:
With
the financial support from the ILO’s Bureau for Employers’ Activities (ILO
ACTEMP), the Promoting the sound industrial relations in
Cambodia: Strengthening the IR services, outreach and representativeness of
CAMFEBA project, this course is specially designed for all HR
professionals and compliance officers who will represent the company in the
labor dispute resolution at all levels. You will learn from the hands-on
experiences of the trainers who have worked with the Arbitration Council
Foundation in providing legal support to the arbitrators. It will provide the
details of the labor dispute resolution process in Cambodia, including the
roles of the Arbitration Council and the court. Most importantly, you will
learn the most practical technique preparing and presenting the case before the
Arbitration Council.
II. Expected
outcomes:
- Be able differentiate between the individual labor dispute and collective labor dispute;
- Understand the labor dispute resolution process in Cambodia from A to Z
- Understand the roles of the arbitration and the court in settling the labor disputes;
- Get practical advice on how to deal with the strikes which happened before the beginning of the arbitration process
- Learn the practical techniques to prepare and present a powerful case before the arbitration council.
III. Training Methodology:
To promote the active participation, the group discussion and
exercises will be used most and less in lecturing. Real case studies quoted
from the cases sent to the Arbitration Council will be used in this exercise.
Mock hearing of the Arbitration Council will also be used at the end of the
course for participants to practice their knowledge.

V. Who should join?
This course is best for HR professionals and Compliance Officers
dealing on the daily basis with personnel issues and who will represent the
company in all labor dispute resolution processes, including at the Arbitration
Council level.

About the Trainers:
1- Mr. Som Chamnan, LLB, B.A
Mr. Som
Chamnan is the Executive Manager and Advisor to the Legal Department of
CAMFEBA. He has extensively practical knowledge and experiences in Cambodian
Labor since he has been practicing this law for nearly 6 years through his work
with CAMFEBA and with the Arbitration Council Foundation as the Legal Officer.
In both careers, Mr. Chamnan was very much involved in doing the research on
Cambodian Labor Law and providing legal advice/support to CAMFEBA’s members and
members of the Arbitration Council, where he also involved in compiling the
Arbitral Awards and providing many training courses to trade unions, employers,
court clerks and law students on the Labor Dispute Resolution Process and the
Arbitration Council in Cambodia, Conciliation Technique, Case Preparation and
Presentation Technique.
Mr. Chamnan possesses the Bachelor Degree in
Law specializing in Labor Law from Royal University of Law and Economics and
Bachelor of Philosophy from Royal University of Phnom Penh. Besides these
degrees, he also has joint many trainings and workshops overseas relating to
the Industrial Relations.
2- Mr. Soum Chamrong, Attorney- at- Law
Mr. Soum Chamrong is an Attorney-at-Law, a Legal and Compliance Manager of CAMFEBA with
the responsibilities in managing the Legal Department of organization and
managing project on promoting the Sound Industrial Relations in Cambodia. He
has experience in providing the legal consultation and represent clients at
Arbitration Council and courts. He holds Bachelor and Master Degree of Law from
the Royal University of Law and Economic in Phnom Penh and Certificate of
Aptitude in Legal Profession from the Lawyer Training Center of the Bar
Association of the Kingdom of Cambodia.
