Technical Skills in Developing the Internal Regulations of Enterprises

The Cambodian Labor Law was developed to provide a general guideline for every enterprise to follow; it was not intended to respond to every specific need of an enterprise. One size will never fit all.

It is worth noting that article 24 of the Labor Law requires every enterprise to develop the Internal Regulations within 3 months after the opening.  Any enterprise failing to comply with this legal requirement will be subject to a fine from 4,00,000 Riels to 12,00,000 Riels.  

More importantly, the Arbitration Council has ruled that disciplinary action applied to workers must be proportionate to the severity of misconduct and be consistent with the company’s Internal Regulations. In addition, article 6(2) of Prakas no. 194/14 MoLVT on the Working Condition and the rule of the Occupational Health and Safety for Entertainment Service Enterprises also provides that the employers or their representatives, who want to impose any sanctions on their employees, shall specify those sanctions in the Internal Regulations or Collective Bargaining Agreement.

Due to above reasons, each enterprise should develop the Internal Regulations to fill in the loopholes of the Labor Law. And this Internal Regulations should be as prescriptive as possible. Without the Internal Regulations, the enterprise will be subject to a fine and may not be able to take disciplinary actions against the employees when necessary.

In order to enable the enterprises to avoid this fine as well as to help them develop the Internal Regulations, 3E Advisory and Training organizes this practical training workshop to share our practical knowledge and hands-on experiences on how to develop a good Internal Regulations. 

EXPECTED OUTCOMES
After joining this training workshop, all the participants will be able to know the legal provisions permissible under the Labor Law and regulations to be included in the Internal Regulations. More importantly, each participant will go back home with a draft of Internal Regulations which is ready for the registration at the MLVT.

Day 1:
  • Short lecture: the legal provisions of the Internal Regulations permissible under the Labor Law and regulations
  • Workshop 1: drafting the Internal Regulations
Day 2:
  • Workshop 2: drafting the Internal Regulations
  • Workshop 3: drafting the Internal Regulations
  • Workshop 4: drafting the Internal Regulations
  • Workshop 5: finalizing the draft of Internal Regulations

TRAINER PROFILE
1- Mr. SOM Chamnan, Advisor of MoLVT, is currently the Advisor to the Ministry of Labor and Vocational Training, where he provides technical and legal support to the General Directorate of Labour and serves as the Deputy Head of the Secretariat of the International Labor Working Group. 

Prior to joining the Ministry, Chamnan was the Manager of the Labor & Compliance Practice Group of Bun & Associates Law Firm; the Legal & Labor Manager of the Garment Manufacturers Association in Cambodia (GMAC); the Executive Director, Legal Advisor, and Labor Law Trainer of the Cambodian Federation of Employers and Business Associations (CAMFEBA); and the Legal Officer of the Arbitration Council Foundation. Chamnan has very extensive and hands-on practical knowledge and experiences in the area of Labor Law and Industrial Relations as he has been practicing this law for over 10 years through advising, providing training and participating in the drafting of many labor regulations.

Under the Australian Leadership Award, Chamnan pursued his study in Australia and obtained the Master of Commercial Law from the University of Melbourne. He also holds a Bachelor of Law from the Royal University of Law and Economic Sciences and a Bachelor of Philosophy from the Royal University of Phnom Penh. Besides, he has also attended many international training/internship programmes, inter alia, the International Internship at the International Labor Organization in Geneva as well as the international training in Italy, South Korea, Japan, Thailand, Singapore, Vietnam.

2- Mr. Ouk Chanthou, Director of Labour Inspection Department of MoLVT, is currently the Director of Labour Inspection Department of Ministry of Labour and Vocational Training. In this position, he is in charge of all work relating to labor inspection and some labor compliances that enterprises need to request from the Labor Inspection Department. Mr. Ouk Chanthou is also a member of many task forces, including the Single Inspection Team and the Project Advisory Committee of the ILO Better Factories Cambodia (ILO BFC).
